2026 FLSA Overtime Rules โ What You Need to Know
Under the Fair Labor Standards Act (FLSA), non-exempt hourly employees must receive 1.5ร their regular rate for every hour over 40 in a workweek. This covers ~143 million US workers. Each workweek is counted independently โ biweekly pay periods cannot average out overtime hours.
The FLSA overtime exemption salary threshold remains $684/week ($35,568/year) in 2026. A 2024 attempt to raise it to $844/week was vacated by a federal court in Texas.
California Daily Overtime Rules
California workers have stronger protections. Overtime triggers after just 8 hours in a single day (not just 40/week). Double time (2ร) applies after 12 hours in a day or on the 7th consecutive workday. Use the Double Time field above if these rules apply to you.
